Gray Proctor will present a CLE course, "SEC v. Jarkesy at 18 Months: Where We Are and Where We’re Going," for the Georgia Bar Administrative Law Section on March 3, 2026, at 12:00 p.m. Eastern.
In his course, Gray will guide attendees through the sea change spurred by the 2024 landmark decision SEC v. Jarkesy. Namely, what has and hasn't changed in constitutional law in light of the Jarkesy decision? How has the test been applied in recent cases under the Court's new approach? This CLE session is geared towards practitioners who are not in tax law but would like to learn more about how potential changes in interpretation may affect their practice areas in light of the two Jarkesy-related Federal Trade Commission cases that will be reviewed by the Supreme Court.
Attendees will learn how to distinguish the three eras of public rights jurisprudence, distinguish legal from equitable remedies, consider the constitutional role of refund jurisdiction and other forms of post-deprivation review, understand the overlooked history of tax penalties as suits at common law, and examine the recent applications of Jarkesy in recent in non-tax cases.
