This panel will discuss the latest updates and practical experiences on tax transparency and CFCs and the impact of these regimes on Latin American private clients.

9:00 – 10:30am: Caroline D. Ciraolo will co-chair a panel titled, “Defending Multiple Fronts – The Prevalence, Perils, and Best Practices of Parallel Civil and Criminal Tax Enforcement Proceedings.”

Description: Governments around the world are prioritizing civil and criminal tax enforcement to identify and hold accountable individuals and entities intent on willfully violating tax laws, and to reduce the substantial Tax Gaps draining much-needed revenue. Tax authorities are using a wide range of domestic and international tools to gather information, documents, and evidence located within and outside their borders to investigate violations. Practitioners representing clients caught in these civil and criminal investigations need to identify the various stakeholders, navigate rules regarding data privacy, preservation, and protection, manage public relations, communicate with law enforcement and regulatory authorities, and negotiate with multiple jurisdictions. The panelists will present the current state of tax investigations in their respective jurisdictions and the perils of and best practices in parallel proceedings.
