We live in a global economy and many clients have sources of income, investments, assets, or activities outside the United States. For U.S. persons, this means having to comply with a complex web of reporting obligations under the Internal Revenue Code and the Bank Secrecy Act. This panel addresses the rules of the road with respect to foreign trusts and the receipt of gifts from foreign individuals and entities. The panelists address the reporting requirements, consequences of noncompliance, paths to compliance, recent enforcement actions and litigation, and best practices in challenging the often substantial penalties.
