Politico Pro turned to Kostelanetz & Fink partner Claude Millman for comment on an appeal by seven students who said the recent expansion of Discovery had unfairly denied them seats in the specialized schools.
The article says: “Claude Millman, the lawyer representing the students, called Elia’s decision a ‘punt,’ saying it was ‘disappointing’ she made the decision close to the start of the new school year and on her last day in office. He also accused her of ignoring most of their claims. ‘The out-going State Commissioner punts on how Mayor De Blasio could invoke “diversity” as a basis to displace an African-American boy with a student who scored 25 points below him, or denying a seat to an African-American and Hispanic girl, so that another student — possibly even White or Asian — whose SHSAT score was 31 points below her score, can take her place,’ Millman said in a statement. ‘The judiciary in Albany should ultimately reject Mayor De Blasio’s irrational system.’”
